The pivot points of the rack are simply for adjusting the angle of the rack instead of the tightness. I did contact the manufacturer on your behalf and per the engineering team at Eco Hitch, you can drill the hole in the sheet metal as you suggested to complete your install of the Eco Hitch Hidden Trailer Receiver # 306-X7221. The guide Saris has for installing that rack on your vehicle is to place the lower feet into the license plate well as opposed to on the bumper like what you have. Typically when we see this type of note it's because the bumper isn't strong enough to hold the weight of the rack and bikes.
