Could I use the swing away in the top of a dual hitch for a bike rack and still use the lower hitch for my flat tow?

Yakima states that you can't use the BackSwing part # Y02483 with any hitch adapters like you mentioned so your best option would be maybe to install a bike rack in the hitch of the vehicle you are flat towing like the Yakima RidgeBack part # Y02458 which is approved for this application.
