How to Ensure that RockyMounts SplitRail # RKY11404 would Allow Truck Tailgate to Fold Down

Is this rack low enough and low profile enough to clear a tailgate when no bikes are on it and it is laying flat?

It would depend on the vehicle but most likely not since the RockyMounts SplitRail # RKY11404 does have a solid amount of rise in the shank. I do have a great solution though with the Yakima Backswing part # Y02483 which will swing the entire rack out and away from the rear of the vehicle to give you complete access to the rear of the truck.
