Is it legal to leave a non folding carrier on your vehicle if the carrier is not in use?

If the license plate is unobstructed like what's in the picture you submitted you'd be fine. All areas are slightly different, but you'd have to had run into a very bored police officer to get a ticket for leaving a cargo carrier installed on the vehicle and the license plate viewable.
We've yet to hear of this being an issue and we sell quite a few cargo carriers.
